The applicant has been arraigned for the offence punishable under Section 7 of the Prevention of Corruption Act, 1988 in Crime No.164 of 2022. 3.
Mr. Bhangde, learned counsel for the applicant submits that though the applicant has been caught in the raid conducted on 05.03.2022 red handed while accepting bribe of Rs.5,000/-, however, the entire investigation is almost complete, and nothing more is required to be done, in view of which, the continued incarceration of the applicant is not justified.

Ms.
Udeshi, learned APP for non-applicant/State opposes the application and submits that though the investigation is almost complete however, since the sanction is awaited, the application be rejected.

The incident is dated 05.03.2021, in which the applicant has been caught red handed while accepting the bribe of Rs.5,000/- The entire investigation is also said to have been completed, except for the formal sanction for prosecution, in view of which, the need for further incarceration does not appear to be justified, as nothing remains to be investigated, considering which, the prima facie a case for bail is made out, hence the following order.
ORDER
(i) The applicant be released on bail in Crime No.164 of 2022 registered with Police Station, Washim, for the offence punishable under Section 7 of the Prevention of Corruption Act, on his executing P.R. bond in the sum of Rs.50,000/- (Rupees Fifty thousand) with two solvent sureties of the like amount.
(ii) The applicant shall not, directly or indirectly make any attempt to influence the witnesses or otherwise tamper with the prosecution evidence.
(iii) The applicant shall attend each and every date before learned Sessions Court and shall ensure that the trial is not protracted on his behalf.
