Heard learned counsel Shri D.V.Mahajan for the applicant and learned Additional Public Prosecutor Shri M.J.Khan for the State. Also, perused reply filed on behalf of the State. Though non-applicant No.2 was served, she chose not to remain present.

After hearing learned counsel Shri Mahajan for the applicant and learned Additional Public Prosecutor Shri Khan for the State, when the Court was about to reject the application, learned counsel for the applicant submitted that he be permitted to withdraw the present application. He submitted that he be granted liberty to file an application for discharge before Court below after filing of chargesheet. 3.

The criminal application is disposed of as withdrawn with liberty to the applicant to file an application .....2/-

Needless to mention that earlier order ordering Investigating Officer not to file chargesheet stands vacated. JUDGE JUDGE !! BRW !!
