The appellant/ applicant has filed this appeal challenging the judgment convicting him for the offence punishable under Section 3(1)(xi) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 and sentencing him to suffer rigorous imprisonment for five years and to pay fine of Rs.Three Thousand and in default of payment of the fine to undergo simple imprisonment for three months. The applicant/ appellant is convicted for the offence punishable under Section 354 of the Indian Penal Code. The victim is a minor girl aged about seven years. Considering the facts on record, I am not inclined to consider the present application praying for suspension of sentence, at present.

The application is dismissed with liberty to the applicant/ appellant to file application after six months. JUDGE RRaut..
