Learned counsel Mr. Mir Nagman Ali would submit that while according to the petitioner, on the face of the averments in the complaint, offence punishable under Section 325 of the Indian Penal Code is not made out, the petitioner shall withdraw the complaint and persuade the learned trial Court at an appropriate stage after the evidence is adduced, that the same provision is not attracted.
