Shri Agnihotri, learned counsel, waives notice on behalf of the original appellant, and Mrs. Kulkarni,

learned Asstt. Govt. Pleader, for non-applicant nos. 2 and 3.

Prayer is to condone delay in filing the CrossObjections. The reasons for the delay are stated in paras 2 and 3 of the application. The prayer is opposed by the learned counsel for the original appellant. However, considering the fact that fair compensation for lands acquired from the same village has already been adjudicated, the delay in filing the cross-objection is condoned, subject to claimants not being entitled for interest on the amount of compensation, if enhanced, for the period from 27th April, 2005 till date.

Civil Application is allowed in aforesaid terms and disposed of.
