02] The petitioners had sought directions to the respondents to grant admission in the vacant seats of M.B.B.S. course. The matter relates to the admission for the academic session 2016-17.

03] As there has not been any interim order, challenges in the petition are rendered infructuous by efflux of time. Hence, the petition is disposed of accordingly with no order as to costs.

04] We find that many matters, which have become infructuous, are unnecessarily pending, as the parties and/or lawyers stop attending the matters. To curb this practice, a suggestion has come from the

wp.1470.17 2/2 learned Advocate appearing for the petitioners that in such matters, costs should be imposed on the erring party/advocate.

05] Hence, the petitioners/advocate appearing for the petitioners are/is directed to deposit costs of ₹5,000/- (Rupees Five Thousand Only) with the High Court Legal Services Sub-Committee, Nagpur and produce receipt of it on record of the petition within two weeks.
