Shri Kalwaghe, the learned counsel for the appellant, states that the appellant has expired during the pendency of the Family Court Appeal and a notice is issued to the Nagpur Municipal Corporation for issuance of the death certificate. It is stated that the cause for filing the Family Court Appeal does not survive on the death of the appellant.

In view of the aforesaid, the appeal stands dismissed as abated.
