Heard the learned Counsel for the rival parties.
Perused the evidence of the material witnesses. Perused the reasons given by the trial judge in relation to the applicants who are claiming bail/suspension of sentence.
Perused the record, it shows that these two applicant were not specifically identified by the witnesses, on the contrary stated that they were unknown persons. In the absence of prima facie evidence against the applicants, I am inclined to grant bail. Hence, the following order :-
Order A] Criminal Application (APPA) No.172 of 2015 is allowed.
B] The sentence of both the applicants is suspended.
C] The applicant shall be released on furnishing a PR bond in the sum of Rs 20,000/- each with one solvent surety in the like amount during the pendency of the appeal.
