Heard. Perused the reply of the prosecution and the charge-sheet filed in this case.

The ossification test report says that the age of the victim could be about 16 years. I have perused the statement of the victim of the crime and also her cousin, who had accompanied her to a place where the victim of crime wanted to ease herself. These statements are prima facie reflective of the conduct of the prosecutrix probably indicating her level of maturity in this case. The investigation is over and so the need for keeping the applicant in custody would not be there. As regards, the likelihood of influencing of prosecution witnesses by this applicant, I am of the view that suitable conditions can be imposed to rule out any such possibility. In the result, the application is allowed and it is directed that the applicant be released on bail on his furnishing a P.R. Bond of Rs.30,000/- together with one solvent surety in the like sum on the following conditions :

The applicant shall stay outside the limits of Tahsil Jiwati, till conclusion of the trial.

ii. The applicant shall not tamper with the prosecution witnesses in any manner.

iii. The applicant shall cooperate with the trial Court in expeditious disposal of the case.

The application is disposed of in the above terms.
