Heard the learned Counsel for the applicant and the learned Counsel for the non-applicants.
Although, the grounds of old age and weakness have been taken, there is no documentary evidence produced on record showing that the health condition of the applicant is of such a nature as he is prevented from undertaking the journey. The medical certificate filed on record shows that the applicant is suffering from hypertension and diabetes since last one year. In the opinion of the Doctor, the applicant required bed rest for three months from 24/01/2016. That period of bed rest is already over. No fresh documents are placed on record to substantiate the claim.
In these circumstances, I find no merit in this application. The application is thus rejected. JUDGE *sdw
