This is an application under Section 439 of the Code of Criminal Procedure. After hearing the learned counsel for the application to some extent, when this Court expressed that the Court is not inclined to grant bail, learned counsel seeks permission to withdraw the application with liberty to file afresh after change in circumstance.

The application is permitted to be withdrawn with liberty to file afresh, if trial is not commenced in near future within one year.
