The response is filed on behalf of the Maharashtra State Power Generation Company Ltd..

We note that the grievance of the petitioner is substantially redressed inasmuch as the respondent has expressed willingness to release the proportionate bank guarantee with interest in favour of the petitioner. 4.

The learned Counsel for the petitioner submits that the petitioner has suffered loss since the respondent did not issue Gate Passes to certain employees engaged by the petitioner.

In writ jurisdiction, we are not inclined to look into the grievance that the petitioner suffered the financial loss SM Gate

957wp 1428.2023..odt due to the refusal to issue Gate Passes. We cannot speculate. It would be for the Civil Court to assess the loss, if any, after the parties adduce the evidence. 6.

With liberty to the petitioner to approach the Civil Court for redressal of the surviving grievance, we dispose of the petition.
