The only prayer made by the petitioner is for a direction to the respondent no.4-Scrutiny Committee to decide the caste claim of the petitioner as early as possible. It is stated on behalf of the petitioner that though the caste claim of the petitioner is pending with the Scrutiny Committee since long, the same has not been decided, as yet. It is stated that a caste validity certificate is granted to the son of the petitioner.

Mrs. Deshpande, the learned Assistant Government Pleader appearing for the Scrutiny Committee, states on instructions that the caste claim of the petitioner is not to be found in the Office of the Scrutiny Committee. It is stated that if the petitioner submits the caste claim in the appropriate format to the Scrutiny Committee, the Scrutiny Committee could decide the same as early as possible.

Since there is a possibility that the papers relating to the caste claim of the petitioner may be misplaced, we permit the petitioner to submit his caste claim to the Scrutiny Committee, so that the Scrutiny Committee may decide the same, as early as possible.

At this stage, the learned counsel for the petitioner states that the caste claim would be submitted to the Scrutiny Committee within a period of three weeks.

WP3081-16 By accepting the statements made on behalf of the parties, we dispose of the writ petition with permission to the petitioner to submit the caste claim to the respondent no.4-Scrutiny Committee and with a direction to the respondent no.4-Scrutiny Committee to decide the caste claim of the petitioner as early as possible and positively within a period of eight months. Order accordingly. No costs.
