Heard learned counsel Shri Nazim Qureshi for the applicants and learned Addl.P.P. Shri A.M.Kadukar for the non-applicant/State. Also, perused reply filed on behalf of the prosecuting agency.

Since investigation is still in progress, looking to magnitude of the offence and when investigation is still going on, after hearing learned counsel for parties, when the Court expressed its opinion that the Court is not inclined to grant bail, learned counsel for the applicants submitted that permission be given to him to withdraw this application. He submitted that liberty be given to the applicants to file bail application afresh before the Court below after filing of the .....2/-

The criminal application is dismissed as withdrawn with liberty to the applicants to file bail application afresh after filing of the chargesheet before the Court below. If such application is moved, learned Judge below before whom the said application will be filed shall decide the same in accordance with law.
