Hearing was conducted through video conferencing and the learned counsel agreed that the audio and visual quality was proper.

The applicant was protected vide order dated 19.03.2021.

This Court noted the submission that the report on the basis of which the applicant is implicated in Crime 63/2021 for offences punishable under Sections 395, 342 and 506 of the IPC is a fall out of a sale transaction. The submission that there is a civil dispute pending and that the truck in question is already seized, was further noted. 4.

On the last date of hearing the learned APP Mrs. Deshpande pointed out that while the vehicle is seized,

aba182.21.O.odt the 30 Metric Tonne (M.T. for short) sand which the vehicle was transporting, is not seized as yet. Mr. Ali, on the basis of instructions received, makes a solemn statement that the 30 M.T. sand shall be duly deposited with the concerned police station. The statement is accepted as an undertaking. 5.

Considering the nature of the allegations and the statement made, the interim pre-arrest protection granted vide order dated 19.03.2021 is made absolute with the only modification that the 30 M.T. sand shall be deposited with the concerned police station within two weeks and that till the charge-sheet is filed, the applicant shall attend the concerned police station as and when required by the Investigating Officer.
