The learned counsel for respondent no.1/claimant not pressed C.A.F.No.1865/2016 as he filed a fresh one i.e. CAF No.1237/2017.
The application is strongly objected by the learned counsel for the appellant. However, in the interest of justice, it will be appropriate, in my opinion, the applicant/claimant/respondent no.1 is permitted to withdraw 75% of the awarded amount upon furnishing surety to that effect.
The application stands disposed of.
