In the light of statements made in the application the Civil Application is allowed in terms of prayer clause (1). Civil Application Nos.458 of 2019 and 985 of 2019. Perused contents of both the applications. For reasons stated therein the delay in seeking restoration of the proceedings against respondent No.1 is condoned. The appeal is restored against respondent No.1. Both the applications are allowed and disposed of. First Appeal No.1080 of 2017 Issue fresh notice of hearing to the respondent No.1, returnable after eight weeks.
