The applicant is arrested on 9.9.2015 in crime registered against three persons (including applicant) for the offences under Sections 302, 201 and 392 read with Section 34 of the Indian Penal Code. According to the prosecution, the applicant is arrested in view of disclosure of his name by the co-accused and his presence on the spot of crime is corroborated by the mobile tower location.

The charge-sheet is filed. The investigation is complete.

ba169.16 The non-applicant has not been able to show that the custody of the applicant is required for further investigation. Considering the facts of the case, in my view, the applicant is entitled to be released on bail, however on certain conditions.

Hence, the following order:- The applicant having been arrested in Crime No.60 of 2015 registered by the non-applicant, he be released on bail on furnishing P.R. Bond for Rs.25,000/- and two solvent sureties in the like amount.

The applicant shall attend the Sessions Trial regularly on every date unless granted exemption by the Sessions Court.

The application is allowed in the above terms.
