Delay of 239 days is caused in filing the restoration application of first appeal.

As per the contention of the applicant, the appeal was listed before the Registrar (Judicial) for non-removal of office objection. The applicant is trying to ascertain the correct address of respondent No.3, however, it could not find out the correct address and the Registrar (Judicial) has passed the conditional order, wherein the appeal was dismissed against the respondent No.3. Now, the appellant has found the correct address of respondent No.3 and will take necessary steps. However, there is a delay of 239 days in filing the application for restoration of the first appeal.

In view of the reasons mentioned in the application, delay of 239 days is condoned.

On furnishing the address of respondent No.3 within two weeks, the appeal against respondent No.3 be restored at its registration stage.
