The challenge is to the action of the respondents in not filling up the entire posts including that of the post which were left vacant because of the non reporting of the candidates, wait-listed etc.

He has invited our attention to the judgment delivered by the Division Bench of Delhi High Court in the matter of Subhash and others vs Union of India (W.P.(C) 5211/2022 and CM Appln 15475/2022) with connected matters delivered on 21-12-2022. According to him, the petitioners are seeking similar relief.

The fact remains that the Delhi High Court has delivered judgment subsequent to filing of the present petition, and that being so, there is no prayer to that effect.

With liberty to the petitioner as prayed by Mr. Charlewar, learned Counsel, to prefer to fresh representation, the Writ Petition stands disposed of as withdrawn.

In case if the petitioners make a representation based on the judgment delivered on 21-12-2022 by the Delhi High Court in Subhash and others vs Union of India (W.P.(C) 5211/2022 and CM Appln 15475/2022) with connected matters, within a period of four weeks from today, we direct the respondents to consider the same in accordance with the judgment referred above, delivered by the Delhi High Court. 6.
Let the decision taken on the representation be communicated to the petitioners within period of three months from the date of such decision.

The petition accordingly disposed of as withdrawn. No costs.
