DATE : 02.07.2015 Heard the learned Counsel for the rival parties. Perused the FIR as well as the statements of the witnesses shown by the learned Additional Public Prosecutor. Admittedly, the deceased survived for 11 days and was also discharged at earlier point of time of the admission in the hospital. Offence under Section 326 of the Indian Penal Code was registered and thereafter converted into Section 302 of the Indian Penal Code. The son of the applicant was released on bail. The applicant had assaulted by means of stick on the head. Looking to the nature of quarrel and the date of arrest of the applicant, namely, 11.9.2014, the applicant deserves to be released on bail. Hence, the following order.

ORDER

Criminal Application No.174/2015 is allowed. The applicant shall be released on bail upon furnishing P.R. Bond in the sum of Rs.20,000/- (Rupees Twenty Thousand Only) with one surety in the like amount.

The applicant and his son shall not enter in the village Islampur till the trial is over.
