Heard the learned Counsel for the rival parties. Insofar as the prayer for quashing of F.I.R. is concerned, we find voluminous evidence against the applicant in the matter of fraud to the extent of Rs.4,20,31,613/-, that was committed with the Maharashtra State Warehousing Corporation in its depot/warehouse at Umerkhed. The Investigating Officer has recorded the statements of witnesses. Paragraphs 5, 6 and 7 of the reply filed by the State clearly show that the applicant is also involved with others in the commission of offence. No case is made out of interference under Section 482 of the Code of Criminal Procedure for quashing F.I.R., as prayed for. We, therefore, make the following order. O R D E R.
Criminal Application No.190/2015 is rejected. Liberty is granted in favour of the applicant to apply for discharge, if so advised, after filing of the charge-sheet. JUDGE JUDGE *sdw
