Learned counsel for the applicant vehemently argued that mobile phones, three in numbers, valuation of which is Rs.12,000/- as per police valuation, should have been released on Suprutnama to the applicant. The offence, in which the said property was seized, is the serious offence under Section 307 of the Indian Penal Code and the allegations of conspiracy for commission of offence etc.
Mr. Jawade, learned counsel for applicant, fairly states that the applicant is property broker. Looking to the seriousness of the crime, I think, the property worth Rs.12,000/- need not be released till the trial is over. Custody of the property shall kept in sealed condition so that it is not damaged. Criminal Application No.191/2015 is rejected.
