I have perused the reasons given by the learned Magistrate for dismissing the complaint in exercise of power under section 256(1) of the Code of Criminal Procedure. The submission is that the proceedings were fixed for return of summons issued to the accused. In view of the submission made, a case is made out for grant of leave to appeal.

Leave is granted.

The appeal be registered.

Let the notice be issued to respondent for final hearing on 30.7.2019.
