O R D E R
(Passed on 25.09.2021) It is informed that the appellant No. 4 (mother of deceased) died on 19.09.2021. The appellant No. 3 Yogesh Giradkar is present for himself and rest of the appellants who are his mother and married sister. On behalf of respondent No. 2 Insurance Co., Regional Manager - Ms. Sarbani Halder is present. The parties have settled the matter before the panel in which it is agreed that the respondent No. 2 Insurance Co. would pay additional amount of Rs. 10 lakhs towards full and final settlement. The amount shall be deposited in the High Court within two weeks from today. The appellant No. 3 Yogesh Giradkar for himself and for rest of the appellants have accepted the same. The appellant No. 3 also agreed that the entire amount can be disbursed in the name of his mother i.e. the appellant No. 1. Parties have also filed terms of compromise which are marked as Article 'A' which is signed by both sides. 2.
The appellant No. 3 - Yogesh made a statement on behalf of himself and the appellant Nos. 1 and 2 that if other legal heirs of appellant No. 4 raises claim then they will settle the same from the amount which is already received by them in terms of this compromise deed for which Insurance Co. would not be liable.

On depositing amount, it shall be disbursed to the appellant No. 1 Pushpa on behalf of herself and all the appellants. 4.
In view of said settlement, the first appeal stands disposed of as settled the matter.

Court fee, if any, be refunded as per Rules.
