Present application is filed by respondent No.1 for seeking permission for withdrawal of the compensation amount. The appeal is already disposed of as partly allowed. 3.

In view of the judgment of this Court, respondent No.1 is entitled to receive Rs. 46,149/- along with accrued interest and the appellant is entitled to refund of Rs.64,289/- along with accrued interest.

As the appeal is already disposed of, the amount of Rs. 46,149/- along with accrued interest be disbursed to respondent No.1 and the amount of Rs. 64,289/- along with accrued interest be refunded to the appellant. Civil application is disposed of.
