DATE : 29.06.2015 Heard the learned Counsel for the rival parties. I have seen the charge-sheet so also the statements of the witnesses. Insofar as the applicant is concerned, there is no evidence against the applicant, particularly, the last seen theory. The learned Additional Public Prosecutor submits that the evidence in the form of CDR is available against the applicant. I think that that itself would not be enough to keep the applicant in jail. Hence, the following order.

ORDER

Criminal Application No.284/2015 is allowed. The applicant shall be released on bail upon furnishing P.R. Bond in the sum of Rs.20,000/- (Rupees Twenty Thousand Only) with one surety in the like amount.

2906ba284.15.odt The applicant shall attend the Police Station, Kanhan, District : Nagpur on last Sunday of every month between 11:00 a.m. to 4:00 p.m., till filing of the charge-sheet The applicant shall co-operate with the Investigating Officer, shall not tamper with the evidence and shall not pressurize the witnesses.
