Heard learned counsel Shri N.L.Jaiswal for the applicant and learned Additional Public Prosecutor Mrs.M.H.Deshmukh for the State.

The applicant was already released on bail by the Trial Court. Though the Trial was proceeded, the applicant remained absent and, therefore, Non Bailable Warrant came to be issued against him. He was arrested. He moved an application for grant of regular bail. The said application came to be rejected. Therefore, the present application is filed to release the applicant on bail. 3.
Learned Additional Public Prosecutor Mrs.M.H.Deshmukh for the State strongly objects the present application.

Offence under Section 354, 363, and 366A read with Section 34 of the Indian Penal Code and Sections 7 and .....2/-
ba215.19 21 8 of the Protection of Children from Sexual Offences Act, 2012 are registered against the present applicant and other accused persons. The applicant was already on bail by the Trial Court. Hence, following order is passed:
ORDER
(i) The criminal application is allowed.
(ii) The applicant be released on bail on the same terms and conditions, as before the Trial Court.
(iii) The applicant shall not tamper with evidence of prosecution witnesses.
(iv) The applicant shall attend the Trial Court on each and every date. If he fails to remain present, the Trial Court is at liberty to issue Warrant and keep him in custody. (v) The applicant shall not leave the jurisdiction of the trial Court without prior permission.
(vi) With this, the criminal application stands disposed of accordingly.
