This petition takes exception to the order dated 25-01-2024 passed by the learned Assistant Charity Commissioner, Chandrapur below Exhibit 82 in Change Report No.69/2019.

ii.

By the order impugned, the learned Assistant Charity Commissioner, Chandrapur has allowed the application filed by the present respondent under Section 73-A of the Maharashtra Public Trusts Act, 1950 (for short, the 'Act') for intervention. iii.

The impleadment under Section 73-A of the Act can be allowed, if that person is having interest in the trust. However, no such finding is recorded in the impugned order. In that view of the matter, the order impugned cannot be allowed to stand and the same is set aside.

The learned Assistant Charity Commissioner shall decide the application at Exhibit-82 filed by the present respondent afresh.
