Heard Shri Sirpurkar, learned Counsel for the applicant.

The application challenges the order dated 28/02/2022, passed by the learned Sessions Court on the application under Section 311 of Cr.P.C., permitting the prosecution to examine two witnesses namely Sau. Shobha Anil Bonde and Ravindra Ambadas Bhande, for whose work, the bribe was demanded.

The learned Sessions Court has recorded in the impugned order that the examination of these two witnesses is

0704 APL 485 of 2022.odt important for a fair and just trial of the matter and since their statements are already recorded, it is not a case as if the accused would be taken by surprise, considering which, I do not see any infirmity in the impugned order. The criminal application is accordingly dismissed.
