Shri D.M. Kale, learned counsel for respondent nos.2 and 3-employer of the petitioner, has placed on record the administrative circular dated 18.01.2023 issued by the Department on the basis of Government Resolution dated 14.12.2022, whereby it has been directed to the Government offices to grant service benefits and post-retirement benefits if person is put on supernumerary post for want of caste validity certificate for the reserved post on which he was appointed. 2.

Needless to mention that pursuant to invalidation of caste claim of the petitioner, the petitioner was put on supernumerary post in wake of the Government Resolution dated 21.12.2019. Now, in the wake of Administrative Circular of the respondent nos.2 and 3 read with Government Resolution dated 14.12.2022, the services benefits and pensionary benefits of the employee who are kept on supernumerary post have been protected. Since Government Resolution dated 14.12.2022 has already been implemented, nothing survives in the petition and therefore, the petition is disposed of as infrucutous. No costs. (M.W. CHANDWANI, J.)
