The petitioner had filed the Writ Petition for a declaration that the provisions of the Maharashtra Mathadi, Hamal and Other Manual Workers (Regulation of Employment and Welfare) Act, 1969 and the scheme framed thereunder, are not applicable to the works carried out by the petitioner.

The petitioner had made an application to the State Government as per the provisions of the Act for a declaration that the works carried out by the petitioner-company did not fall within the provisions of the Act and the Scheme. This Court had, by an order dated 18th April 2015, observed that it is open to the State Government to decide

06.10.wp.2142.15 the Application of the petitioner during the pendency of the Writ Petition.

It is stated on behalf of the petitioner that the State Government has now decided the Application and rejected the same. It is stated that the petitioner is desirous of filing appropriate proceedings for challenging the order of the State Government. The learned counsel for the petitioner, therefore, seeks permission to withdraw the Writ Petition.

The permission to withdraw the Writ Petition is granted. The Writ Petition is disposed of as withdrawn. The points raised in the petition are, however, kept open.
