This contempt petition was filed raising a grievance that the directions issued on 08.03.2022 in Writ Petition No.1302 of 2022 have not been complied with. By those directions, the Chief Executive Officer, Zilla Parishad, Gondia was directed to give hearing to the petitioner within a period of three working days on the petitioner submitting necessary documents. After notice was issued in the contempt petition and as the petitioner had an apprehension that the funds available for the Financial Year 2021-22 would lapse, we had requested Shri A.M. Deshpande, learned Additional Government Pleader to have a talk with the Chief Executive Officer, Zilla Parishad, Gondia as regards the status of the proceedings. Shri A.M. Deshpande, learned Additional Government Pleader has placed on record a communication dated 30.03.

2022 in which the Chief Executive Officer has stated that since the necessary records/ documents were not submitted by the petitioners within the time that was granted, the hearing could not be undertaken. It is further stated that the funds in question would not lapse at the end of Financial Year 2021-22 and the same would be available for a period of five years. In view of this communication the learned counsel for the petitioner seeks leave to withdraw the contempt petition. We do not find any wilful disobedience of the order passed in Writ Petition No.1302 of 2022. Hence, the contempt petition is permitted to be withdrawn. No costs. (SMT. M.S. JAWALKAR, J.) (A. S.
