Apprehending the arrest at the hands of police in connection with Crime No.50/2025 registered with Police Station Sakkardara, Nagpur, District Nagpur for the offences punishable under Section 305(a) of the Bharatiya Nyaya Sanhita, 2023, the applicant approached this Court for grant of pre-arrest bail.

Learned Counsel for the applicant submitted that the crime is registered on the basis of report lodged by Anil Ramchandra Shingade on an allegation that the present applicant who is his relative had been to his house for medical treatment and committed theft at his house worth of Rs.72,000/-. On the basis of the said report, police have registered the crime against the present applicant.

Learned Counsel for the applicant submitted that merely on the basis of suspicion the said report is lodged. In fact, no such incident has occurred. As far as
the custodial interrogation is concerned which is not required. He submitted that nothing in on record to show that the informant was having the said gold ornaments in his house at the relevant time. Even accepting that the applicant is ready to cooperate with the investigating agency and ready to attend the concerned police station. The custodial interrogation of the present applicant is not required.

Learned APP strongly opposed the application and submitted that the investigation is at initial stage and her custodial interrogation is required, and therefore, the the application deserves to be rejected.

I have heard learned Counsel for both the sides. Considering the investigation papers the investigating agency requires the custody only for the purpose of the interrogation which can be taken care of by imposing certain conditions on the present applicant. In view of that, the application deserves to be allowed. Accordingly, I proceed to pass following order: (i) The application is allowed.
(ii) In the event of arrest, the applicant - Smt. Varsha Devidas Gohokar in connection with Crime No.50/2025 registered with Police Station Sakkardara, Nagpur, District Nagpur for the offences punishable under Section
305(a) of the Bharatiya Nyaya Sanhita, 2023, be released on anticipatory bail, on executing P.R. Bond in the sum of Rs.25,000/- with one solvent surety in the like amount.
(iii) The applicant shall attend the concerned police station twice in a week i.e. on every Monday and Thursday between 10.00 AM and 1.00 PM and shall cooperate with the investigating agency.
(iv) The applicant shall not induce, threat or promise any witnesses who are acquainted with the facts of the case either personally or by way of electronic media.
(v) The applicant shall furnish her detailed address with address proof, before the investigating agency.

The contravention of any of the condition imposed by this Court would lead to the cancellation of bail.

The application stands disposed of.
