The learned advocate for the applicant, on instructions, seeks permission to withdraw the application with liberty to file appropriate application praying for discharge, before the learned trial Magistrate. The application is disposed as withdrawn with liberty as prayed for. If the application praying for discharge is filed within one month, the learned Magistrate shall dispose it within three months from the date of filing, considering the fact that the applicant has already retired on attaining the age of superannuation. In the circumstances, the parties to bear their own costs.
