Heard Shri Amol Hunge, learned counsel for the applicant and Shri M.K. Pathan, learned APP for the non-applicant.
This is a joint application filed by the complainant and the accused for quashing of criminal proceeding initiated by the respondent vide R.C.C. No. 196 of 2017 pending before the Judicial Magistrate First Class, Kamptee.
Applicant No. 1 is said to be the husband of applicant No. 5 - complainant. Applicant Nos. 2, 3 & 4 are the father-in-law, brother-in-law and motherin-law of applicant No. 5. The marriage of applicant No. 1 and applicant No. 5 was solemnized on 28.11.2016 at Kamptee.
On 22.04.2017, applicant No. 5 lodged a
1303apl285.20 report against applicant Nos. 1 to 4 and on the basis of said report, Crime No. 184 of 2017 came to be registered on 15.06.2017 at Police Station Kanhan, Nagpur (Rural) for the offence punishable under Sections 498-A, 323 and 506 read with Section 34 of the Indian Penal Code.
Today, all the applicants in person along with their counsel are present before this Court and submitted that they have amicably settled their dispute and applicant No. 5 does not want to prosecute her case further. Applicant No. 5 further states that at the time of lodging of report, she was not in good mental condition and was under the pressure of her parents and relatives and now she wants to cohabit and live peacefully with applicant No. 1.
Considering the nature of the offence and the allegations and the settlement arrived at between the applicants, we are inclined to allow the present Criminal Application and the same is allowed. Criminal proceedings pending before the J.M.F.C. Kamptee in R.C.C. No. 196 of 2017 are quashed and set aside.
