DATED : 09/03/2023 The petitioner has filed Appeal bearing No. A-01/2021 under Section 81 of the Maharashtra Public Universities Act, 2016 (for short the "Act of 2016") challenging the communication dated 01.02.2021 by which, he has been removed from the post of Junior Clerk. It is the grievance of the petitioner that such appeal having been filed on 11.03.2021 and the pleadings being complete, it ought to be heard in the light of the provisions of Section 82(3) of the Act of 2016.

We have perused the writ petition and documents filed alongwith the appeal. It is seen that an application for early disposal of the appeal dated 09.02.2023 has been preferred by the petitioner.

In these facts, the interests of justice would be served by requesting the learned Presiding Officer, University and College Tribunal, Nagpur to consider the petitioner's application dated 09.02.2023 in the light of the provisions of Section 82(3) of the Act SMGate

27wp 1483.2023.odt of 2016 so as to decide the appeal finally. The said application can be considered on the next date of the proceeding which is stated to be 16.03.2023, in accordance with law.

The writ petition is disposed of. No costs.
