DATE : 14/01/2022 The applicant as well as non-applicant is present in the Court, along with their respective counsels and submit that the matter has been settled between them in terms of the document dated 4.12.2019, placed on record (page 42) and the non-applicant admits to have received the entire compensation as per the terms of the settlement. It is therefore prayed that the offence be permitted to be compounded.

Considering that the settlement has already occurred as is evinced by the settlement deed dated 4.12.2019 and the assertion of the non-applicant of having received the entire compensation as per the terms of the settlement, the offence under Section 138 of Negotiable Instruments Act is allowed to be compounded under Section 147 of the NI Act and the applicant is discharged of the offence punishable under Section 138 of NI Act.
