Since, respondent No.4 is no more and died on 16/10/2017, his share shall be distributed equally amongst respondent Nos.1 to 3. Accordingly, the application is disposed of. First Appeal No.1261 of 2024:

The appellant to take steps to delete the name of respondent No.4 and to serve upon respondent No.5. 02.
