SEPTEMBER 12, 2024 Heaving heard for some time, when the Court was not inclined to grant relief, learned counsel for the petitioner seeks permission to withdraw the petition with liberty to take up the appropriate remedy before the Family Court, Amravati. Permission granted.

Writ petition is dismissed as withdrawn with liberty as prayed for.

Petitioner in the present case, in compliance of order dated 28.08.2024, paid costs of Rs.20,000/- in terms of order dated 30.04.2024 and also filed affidavit stating therein that till date, he has paid Rs.6,04,500/-to the respondent. According to the counsel for the respondent, this amount has been not paid. He submits that to the best of his knowledge, an amount of Rs.4,00,000/- is paid.

If that be so, he may proceed to take appropriate proceedings for recovery of amount before appropriate forum. Since the petitioner has complied order passed by this Court, there is no reason why should contempt proceeding be invoked.

Order accordingly.
