The applicant, apprehending arrest in crime registered against him and two others for the offences punishable under Sections 307, 394 and Section 34 of the Indian Penal Code, has sought pre-arrest bail. The crime is registered on the complaint that during the procession taken out to celebrate victory of a candidate in municipal council elections some dispute arose because of shutting down of DJ System and the accused assaulted the complainant. According to the Investigating Agency the applicant assaulted the complainant by fist and gave blows and co-accused Rinku assaulted the complainant on his head with a stick. The applicant, aged about 20 years, claims to be the student, which fact is not controverted by the nonapplicant. The applicant has stated that he is not involved in any other crime/ offence. The non-applicant has not been able to show that the custody of the applicant is required for further investigation.

2 aba156.17 Considering the nature of the accusations against the applicant and the above facts, following order is passed: In the event of arrest in Crime No.819/2016, registered by the non-applicant, the applicant be released on bail on executing P.R. Bond for Rs.Twenty Thousand. The application is allowed accordingly.
