This Court on 15.10.2015 accepted request of the respondent for expeditious hearing and appeal was directed to be placed for hearing in week commencing from 23.11.2015.

Thereafter Shri Kshirsagar, learned counsel for respondent pointed out that the respondent is a cancer patient and needed money desperately, we therefore, scheduled the appeal for hearing today.

Order 1412fa676.09 When it is called out for hearing today, parties jointly state that in view of the amendment to provisions of Bombay Civil Court Act on 01.09.2015, as the valuation of present appeal is below Rs. 1 Crore, it is required to be heard by the District Court, Nagpur. 4.

Accordingly we direct the Registry to forward the appeal memo along with record and proceedings immediately to the office of District Court at Nagpur.

Keeping in mind the urgency of the matter, the court hearing Regular Civil Appeal shall attempt to decide it at the earliest.
