DATE : 21-03-2023 The petition challenges the order dated 18-01-23, raising a grievance regarding the rate of sand per brass taken into consideration by the respondents while calculating the penalty. It is contented that the rate is too high. Though, Mr Ingole, learned Counsel for the petitioner has tendered across the bar communication by the Collector, Yavatmal, alongwith tabular chart, indicating the rates of various minerals calculated for levying the penalty, which indicates that the rate of sand per brass is Rs 6000/-. What has been the rate imposed in the present matter which is Rs.5000/- per brass is less than that. No other material has been placed to indicate any infirmity in the mode of calculation, considering which, I am not inclined to interfere in the order impugned in this petition. The petition stands dismissed. No costs.
