Heard the learned Counsel for the rival parties.

Perused the F.I.R. as well as the reply. The other allegations against the applicant are that he purchased the suit property pursuant to the decree in his favour in the proceedings of execution and he did so fully knowing that Ankush Kadu had fraudulently purchased the said property. That being so, I think the applicant prima facie has not committed any offence as alleged against him. Hence, I make the following order :- Order A] Criminal Application (ABA) No.162 of 2015 is allowed.

B] Rule is made absolute in terms of interim order granted by this Court on 23-03-2015.
