Shri A.D.Mohgaonkar, learned Advocate for the appellants states that the order passed by the University and College Tribunal condoning delay in filing appeal was challenged before the learned Single Judge in Writ Petition No. 4221 of 2004 which is decided on 3rd January 2005. It is submitted that during pendency of this Letters Patent Appeal, the substantive appeal filed by the respondent/employee is decided on merits. Hence, this Letters Patent Appeal has become infructuous. The Letters Patent Appeal is disposed accordingly. No costs.
