The applicant is arrested on 29-02-2016 in crime registered against him for offences punishable under Section 304 Part-II and Section 140 of the Indian Penal Code.

The accusations against the applicant are that he laid live wires on the boundary of his field with current flowing through the wires, to protect the crops from animals and the deceased owner of adjacent field while watering the crops of his field suffered electric shock and died on the spot.

Though the bail application is opposed on the ground that the investigation is in progress, in my view, considering the nature of incident and the facts on

2 ba180.16 record, the applicant is entitled to be released on bail, however, on certain conditions.

Hence, the following order :

i) The applicant having been arrested in Crime No.67/2016 registered by the non-applicant, the applicant be released on bail, on furnishing P.R. Bond for Rs.25,000/- and one solvent surety in the like amount.

ii) The applicant shall attend the Police Station Gondpipri, District Chandrapur on every Wednesday between 11-00 a.m. to 1-00 p.m. till the charge-sheet is filed.

iii) After the charge-sheet is filed, the applicant shall regularly attend the sessions trial unless granted exemption by the Sessions Court.
