DATE : 6.5.2016 Heard Shri C.R. Thakur, advocate for the applicant/appellant and Shri S.M. Bhagde, A.P.P. for the nonapplicant/respondent. The applicant/appellant was on bail during the trial and nothing adverse is reported against him. There is no likelihood that the appeal will be taken up for hearing in near future. In my view, the sentence imposed on the appellant is required to be suspended.

Hence, the following order:

(i) The sentence imposed on the appellant is suspended. (ii) The appellant be released on bail on same terms and conditions as before the Sessions Court.

(iii) The criminal application is allowed accordingly.
