DATE : MARCH 30, 2015 Prayer is to permit respondent No.1 to withdraw the amounts deposited by the appellant before the Reference Court.

It is submitted that by earlier order dated 26/09/2014, such permission was granted. However as it was stated in the order that the aforesaid amounts have been deposited in this Court, the same could not be withdrawn.

Considering the earlier order dated 26/09/2014, the application is allowed in terms of said order. Solvent surety be furnished before the Reference Court while independent undertaking be filed in this Court within period of two weeks from today. On such compliance, respondent No.1 would be permitted to withdraw the amounts as deposited. C.A. is disposed of.
