Shri De, learned counsel for the applicant/ petitioner submits that as competitor is inadvertently not joined as party respondent, amendment to civil application is necessary.

Instead of allowing amendment to the civil application, we grant liberty to the petitioner to file a fresh application with the same prayers by adding that competitor as party respondent.

With said liberty to the applicant/ petitioner, civil application is disposed of. No costs.
