This application is for condonation of delay which is caused in preferring restoration application. The appeal was dismissed due to the non-removal of the office objections, as the office objections are not removed within a period of two weeks. It is submitted by learned Advocate Mr. Sagdeo that the conditional order passed by this Court is not inadvertently noticed by the applicant therefore it could not be complied. 3.

The application is strongly opposed by Ms. Patil, learned counsel for respondent No2 and Ms. Udeshi learned A.G.P. for respondent Nos.1 and 3.

In view of the reasons mentioned in the application, delay of 33 days is condoned.

MISC. CIVIL APPLICATION (ST.) NO. 5173 OF 2023 Learned Advocate Mr. Sagdeo submitted that he has now removed the office objections.
